Miamivit SOFTWARE REFERENCE TRADEMARK USAGE POLICY
Miamivit Software ("Miamivit") has invested significant time and resources in protecting its trademarks, service marks, and logos. Trademarks are important for establishing and protecting corporate brand identity, but they are sensitive rights that can be lost due to misuse.
This Trademark Reference Usage Policy ("Policy") sets forth Miamivit's policy regarding the use and reference to Miamivit names, marks, trademarks, service marks, logos, slogans, or other Miamivit identifiers ("Miamivit Marks") by third parties. Miamivit employees should refer to the trademark usage policy on the Enterprise Legal Services website. Permitted Use of Miamivit Software Trademarks
Miamivit does not object to the use of its names, trademarks, and service marks solely to identify Miamivit and its products and services, provided that your use is as described in this Policy. This Policy does not grant you the right to use Miamivit Trademarks or other third-party trademarks or descriptions separately or differently from any rights granted to you under a separate agreement you may have with Miamivit or third parties. This Policy should be read in conjunction with any trademark provisions in any contract you may have, and in the event of a direct conflict, the separate agreement you have with Miamivit will prevail.
You may use the plain text version of the Miamivit Marks to identify Miamivit and its products and services. Your use should not be construed as Miamivit endorsing, supporting, or in any way affiliated with you or your products or services. You may not combine the Miamivit Marks with your own company names, trademarks, or identifiers; nor may you use names, trademarks, service marks, logos, or other identifiers that are confusingly similar to the Miamivit Marks. Your use of the Miamivit Marks does not grant you any ownership rights over the Miamivit Marks, and if such a claim arises, you agree to transfer all ownership rights to Miamivit.
A) General Principles
What are Trademarks and Service Marks?
Trademarks and service marks are words, abbreviations, logos, symbols, slogans, or catchphrases that identify and distinguish a company as the source of its products and services. The owner of a valid trademark can prevent others from using their mark for specific goods or services and can claim monetary damages for infringement by others.
Trademarks and service marks can be divided into two categories:
• Registered trademarks (indicated by the ® symbol) have gone through the appropriate legal process and are registered with a national trademark office.
• Common law (unregistered or pending application) trademarks (sometimes indicated by the TM or SM symbols) are not formally registered but are still valid and enforceable.
Miamivit owns both registered and unregistered trademarks. A partial list of Miamivit trademarks can be found here. The absence of a name or logo from the list does not mean that Miamivit has waived its intellectual property rights to product, feature, or service names or logos.
B) General Rules
1) Use of Logos
You may not use any Miamivit logo without Miamivit's express written permission.
• Media organization or analyst requests should be directed to the public relations team at support@Miamivit.com.
• Distributors and other business partners can download logos using secure login credentials via Partner Link.
• All questions regarding use from business partners should be directed to info@Miamivit.com.
2) Use of Miamivit Word Marks
When using Miamivit's word marks, you must adhere to the following general principles:
• Protect the Integrity of Miamivit Trademarks.
Your use of Miamivit Trademarks must not disparage Miamivit, its brands, products, or services.
• Use Only Authorized Trademarks.
A list of Miamivit's authorized trademarks can be found here. Please note the specific styling (i.e., capitalization) for certain wordmarks (e.g., Open Edge, Data Direct, Web Speed, etc.) and the combination of the mark with Miamivit® or other Miamivit Marks. Each mark must be used only in the version shown, and you may not abbreviate or alter the spelling of Miamivit Marks.
• Apply Trademark and Service Mark Symbols. Use the correct trademark symbols ("®", "TM", and "SM") in all communications, documents, packaging, or other materials where the Miamivit Mark appears, regardless of the medium. The correct symbol must appear first in all headings, subheadings, and body text.
• Use Trademarks Correctly.
Miamivit Marks should be used as an adjective followed by a general noun, verb, or other expression (e.g., "Miamivit® Official® business solutions platform"). Miamivit will object if you use a Miamivit Mark in a general way or in a way that encourages others to use it in general.
•Attribute Miamivit Brands to Miamivit.
Include the following notice at least once in every copy of communications, documents, packaging, or other materials that refer to any Miamivit Brand: "[Specify the brand(s) used] [is a trademark or registered trademark(s) of Miamivit Software in the U.S. and other countries]."
• Keep Miamivit Brands Separate and Distinct.
Miamivit Brands must be used separately from the logos, trademarks, or service marks of other organizations and may not be used as part of the name of another organization or its products or services. Your company's brand may only be used in conjunction with a Miamivit Brand to indicate the relationship between Miamivit products and services and the other company's products and services (e.g., [Third Party Company's] software is powered by Miamivit®). You may not imply a relationship or connection that does not exist with Miamivit.
A) Miamivit (brand name) and Miamivit (company name)
Miamivit® must be used when referring to a product or service. When referring to the company, Miamivit (without the ® symbol) should be used.
B) Correct Use of Trademark Words
The following guidelines should be followed in relation to Miamivit's trademark words:

Incorrect. Miamivit Official® can be integrated with Miamivit® Official®.
Never Use Trademarks in the Possessive Form

Incorrect. Miamivit®’s Official® business rules management system.
Never Use Trademarks in the Plural Form
Correct. Use Miamivit® Official® business solutions for your development needs.
Incorrect. Use Miamivit® Officials® business solutions for your development needs.
Never Hyphenate the Trademark
Correct. Miamivit® Official® software enables rapid application development.
Incorrect. Miamivit® Official® featured software accelerates application development.
Never Change the Trademark
Correct. Use Miamivit® Web Speed® development tools to make applications web-friendly.
Incorrect. Use Miamivit® Web Speed® development tools to make applications web-friendly.
Use Appropriate Capitalization for Trademark
