Miamivit Software Corporation, including but not limited to all its affiliates and subsidiaries ("Miamivit", "we", "our" or "the Company"), is committed to protecting the privacy of individuals who visit the Company's websites, register to use our services, and register to attend the Company's corporate events. This Privacy Policy ("Policy") describes Miamivit's privacy practices relating to the use of the Company's websites and related applications, services, and programs offered by the Company, as well as individuals' preferences regarding the use, access, and correction of personal information.
This Policy applies to the information practices of our websites linking to this policy, including but not limited to www.Miamivit.com, and all international domain names and subdomains and/or other websites owned or controlled by Miamivit ("Sites"). Please note that the Sites may contain links to other company websites. Please note that our privacy policy does not apply to these other websites. While Miamivit takes great care in selecting content for our Sites, including links to third-party websites, we are not responsible for the content found on those other websites. We recommend that you review the privacy notices of other websites to understand their information.
Information Collected and Monitored by Miamivit Software
Miamivit may collect various types of information from visitors to our website or from telephone or email communications. These are described in more detail below. In some cases, we may combine one type of information with another and store them together in our records. However, in all cases, we strive to limit the amount of information we collect and store to what is necessary to provide you with the relevant services.
Collected Corporate and Personal Information
On our sites, you may be asked to provide personal or corporate information in order to purchase or receive information about a Miamivit Property. We may collect this information through various methods, including (but not limited to) the following:
• Registration Forms. We encourage all visitors to register with Miamivit; however, registration is not mandatory except for access to our premium content areas. Registration forms require users to provide accurate contact information and testimonials so that we can better serve you. You will be given unique account information in connection with creating an account with us, and it is your responsibility to keep your account information confidential at all times.
• Order Forms and Registration Forms. Our order forms securely collect visitors' contact and payment information for order fulfillment purposes, and this information may be shared with our business partners or dealers if necessary to fulfill your request. During the purchase process, you may have the opportunity to sign up for future emails regarding our products, services, and promotions.
• Registration Profile. You may also be offered the option to create a profile to store your name, purchase history, and billing information to make it easier for you to shop with us and purchase products/services in the future. You can change/cancel your profile information online at any time.
• Online forums and social networks. Any Personal Information you choose to post to one of our online forums or social networks may be read, collected, or used by other people visiting these community spaces. You should carefully consider whether you wish to post Personal Information to these forums or social networks and adjust all content you post accordingly.
Personal Information collected by Miamivit Software may include, but is not limited to:
• Contact information (such as your name, title, email address, postal address, and telephone number);
• Transaction information;
• User preferences;
• Financial/credit card and payment information (please see the "Third-Party Payment Processor" section for more information);
• Demographic information and geographic or location information; and
• Additional information needed for our business and customer service purposes.
Where applicable, if you choose to access or log in to any Miamivit Software Website using your Google, Facebook, Yahoo, or other accounts accepted by the respective Miamivit Software Websites, the third-party site may share certain Personal Information with us.
Sensitive Information
We ask that you do not send or otherwise share with us any sensitive Personal Information, including but not limited to your government-issued identification numbers (such as your Social Security Number or driver's license number), your racial or ethnic origin, your political or religious opinions, or your health information.

Tracking Signals
Because there is no common industry or legal standard for interpreting Tracking Signals (DNT), Miamivit Software scanners do not respond to DNT signals. We will continue to monitor the development of a DNT standard by the privacy community and the industry.
How Miamivit Software Uses and Shares Personal Information
Miamivit Software does not sell, rent, or lease Personal Information you share with us to third parties. However, the information you provide may be used by us or shared with third parties for any of the following purposes (please note that not all of the uses listed below may be suitable for you):
With your permission (where necessary), we may use and share the Personal Information we collect for the following purposes: to provide, support, and improve Miamivit Properties; to provide correspondence, communications, or services such as newsletters, events, training, or software that you have requested or purchased; to process orders; to verify license compliance; to obtain your feedback; and to inform you about the products and services of the Company and our distributors, dealers, and promotional partners.
We may also use your Personal Information as described below:
• From time to time, we may share your Personal Information and other information with other companies that may provide you with information about the products and services they offer.
• We may aggregate your Personal Information and other information that does not personally identify you. We may share this aggregated data with our affiliates, agents, advertisers, manufacturers, business partners, and current and potential business partners, and with other third parties for other lawful purposes.
• We may share, disclose, or provide your Personal Information to third parties: (i) when attempting to collect a payment or debt; (ii) when necessary to combat fraud or protect our interests; (iii) to enforce our Privacy Policy, Terms of Use, or any of Miamivit’s terms of service or end-user license agreements; (iv) when required by law or in response to a legal process or legal request, including from law enforcement or government agencies; (v) between our affiliates and subsidiaries; or (vi) as part of a merger, sale, or dissolution of our business or assets.
• We may employ other companies and individuals to perform functions on our behalf. Examples include providing hosting and networking services, information technology support, and customer service. These other companies will only have access to the Personal Information we collect to the extent necessary to perform their functions and to the extent permitted by law.
• Miamivit may store, aggregate, use, and resell non-personal information (including other information) collected in connection with any use of the Sites or our products and services, both during and after your use.
Furthermore, while you browse our Sites, our web servers collect non-personal information relating to your visit for the purpose of operating and improving Miamivit Features, monitoring Site trends and statistics, and preventing Product license abuse. Through server logs, we track statistics such as the number of visitors to our Sites, which pages on the Sites are most frequently visited, and which domains visitors come from to the Sites. While we collect such information, none of it is individually linked to you. We use this statistics to improve our Sites, monitor their performance, and make the Sites easier for you and other visitors to use.
European citizens can submit requests regarding their personal data collected by Miamivit (including but not limited to requests for access to and/or deletion of their personal data) by visiting our GDPR Data Subject Access Request page.
Informed Consent Regarding Data Collection and Processing
Miamivit will rely on our current and potential customers to determine what information they wish to receive about our products, services, and business partners, and will inform all visitors to our websites about their rights regarding data collection and tracking, and provide them with the opportunity to change their preferences in the future.
Controlling Your Communication Preferences
Our sites allow users to control the communications they receive from us. You can visit the Miamivit Preference Center at any time to change your communication preferences, including unsubscribing from various communication options. However, some non-marketing communications, such as product downloads, sales transactions, software updates and other support information, patches and fixes, conferences or events you've registered for, and statements to comply with legal requirements, are not subject to the general unsubscribe option. This also includes communications with business partners, including product alerts, updates, marketing and sales materials, and other notifications related to partner status.
Third-Party Payment Processor
We use third-party service providers ("Payment Processors") to manage credit card transactions. Under our agreement with these service providers, they are not permitted to store, retain, or use your Personal Information or billing information on our behalf, except for credit card transactions. In some cases, we may have access to the last four digits of your credit card number, expiration date, and billing address, and we will only use this information to help us provide the product or service you purchased. Additionally, we and our service providers may use all information processed under this section in aggregate for internal business analytics and fraud prevention purposes.
Communications on the Sites
Personal Information or other content you choose to post in any forum on the Sites may be read, collected, or used by others visiting those forums and may be used to send you unsolicited messages. We are not responsible for any Personal Information or other content you choose to post in those forums.
Any content or Personal Information you post on the Sites may also appear in search engine results (such as Google, Yahoo!, and Bing), in the caches of those search engines, in feeds, and on third-party sites in accordance with TOCO brand agreements. We have no control over the updating and/or removal of such content or Personal Information, and this is entirely the responsibility of the search engines, third-party sites, and RSS web feed sources. You acknowledge and agree that we are not responsible for any content or Personal Information you post on the Sites or any information published on any third-party site or in search results that carries such content or Personal Information. We strongly advise against posting any content or Personal Information that you do not want others to see or use.
We do not and cannot review any communications and materials posted or created by users visiting the Sites or using the Services. However, we reserve the right, at our sole discretion, to block or remove communications, content, Personal Information, or other submissions sent to the Sites for any reason whatsoever.
Our Security Practices
Miamivit uses industry-standard security measures to ensure information security. However, the security of information transmitted over the internet can never be guaranteed. Miamivit is not responsible for any interruption or blocking of communication over the internet, or for any changes or losses of information. Users of our sites are responsible for ensuring the security of all passwords, user IDs, or other authentication methods used to access password-protected or secure areas of our websites. To protect you and your information, Miamivit may suspend your use of the website without notice until an investigation is complete in the event of any suspected security breach. Access to and use of password-protected and/or secure areas of Miamivit Software sites is restricted to authorized users only. Unauthorized access to these areas is prohibited and may lead to criminal prosecution.
We have implemented physical, electronic, and administrative procedures designed to help prevent unauthorized access, ensure data security, and properly use the Information we collect online. These security measures vary depending on the sensitivity of the information we collect and store. We also use administrative, technical, and physical security measures to help protect your personal information. While we have taken reasonable steps to secure the personal information you provide to us, please note that despite all our efforts, no security measure is perfect or impenetrable, and no method of data transmission can be guaranteed against any interference or other misuse. All information disclosed online is vulnerable to interference and misuse by unauthorized persons. Therefore, we cannot guarantee complete security if you provide your personal information.
Service Providers
We utilize third parties to help us provide you with various services when you use Miamivit Properties. When you subscribe to receive any of these services, we will only share your Personal Information with the third party where necessary for the purpose of providing that service. We may also utilize specialized third parties for our subscription billing platform.
These companies may use your information to help Miamivit Software and our partners contact you about offers. These companies do not have an independent right to share this information. We will obtain your initial consent before sharing your Personal Information. If you do not wish your information to be shared with these third parties in the future, you may Contact Us; however, please note that this option may prevent you from licensing certain products due to our point-of-sale processes.
Commitment to Children's Online Privacy
Miamivit Software Websites are not intended for children. Miamivit Software does not knowingly accept online Personal Information from children under the age of 18. If you are under 18 or require parental or guardian consent to share information with Miamivit Software, you should not share any information about yourself.
Cross-Border Transfer of Your Personal Information
We are a global company and have developed global data practices designed to ensure that your Personal Information is appropriately protected. Please note that your Personal Information may be transferred, accessed, and stored globally as necessary for the purposes stated above in accordance with this policy.
Because Miamivit Software is headquartered in the United States, we may need to transfer information collected from our customers outside the US to the US. We may also need to transfer our customer information (regardless of where you live) to other countries or locations where we or our agents/contractors have offices or facilities.
Where personal data provided to Miamivit by its customers and business partners is transferred from the European Union and Switzerland to the United States, Miamivit complies with the EU-US and Swiss-US Privacy Shield Frameworks established by the U.S. Department of Commerce regarding the collection, use, and storage of such data. To ensure compliance with the Privacy Shield, Miamivit is subject to the investigative and enforcement authority of the U.S. Federal Trade Commission. Miamivit undertakes to cooperate with and comply with the recommendations of all relevant EU data protection authorities (DPAs) and the Swiss Federal Data Protection and Information Commissioner (FDPIC) with regard to human resources data transferred from the EU and Switzerland within the scope of employment relationships.
In compliance with the Privacy Shield Principles, Miamivit may transfer personal information to third parties, including transfers from one country to another. We will disclose an individual's non-public personal information to third parties only if (a) a third party providing services to Miamivit or in connection with the activities of our business and consistent with the purpose for which the personal information was collected, (b) with the data subject's consent, (c) when necessary to fulfill a legal obligation, or (d) when reasonably necessary for compliance, regulatory, or other legal purposes. Miamivit maintains written agreements with relevant third parties to ensure they provide at least the same level of privacy protection and security required by the Privacy Shield Principles. To the extent provided by the Principles, Miamivit remains liable and responsible under the Privacy Shield Principles if a third party it has commissioned to process personal information on its behalf does so inconsistently with the Privacy Shield Principles, unless Miamivit proves that it is not liable for the resulting harm.
In the event of non-compliance with the Privacy Shield Principles, Miamivit undertakes to resolve any complaints regarding the collection or use of your personal information. EU and Swiss citizens with questions or complaints regarding our Privacy Shield policy should first contact Miamivit at support@Miamivit.com. Emails sent to this address will be received and reviewed by Miamivit's Data Protection Officer.
Miamivit also undertakes to forward unresolved Privacy Shield complaints to JAMS, an alternative dispute resolution provider located in the United States. If your complaint is not addressed to your satisfaction or acknowledged by us in a timely manner, please contact us for further information or to file a complaint, or visit https://www.jamsadr.com/eu-us-privacy-shield. JAMS's services are provided to you free of charge.
If your complaint is not resolved through these channels, under limited circumstances, a binding arbitration option before a Privacy Shield Panel may be available.
Correction and Updating Your Personal Information
Miamivit may retain your information for a period consistent with the original purpose for which it was collected. For example, we may retain your information for a reasonable period during and after the time you have an account to use our Sites or Services. We may also retain your information for a period necessary for Miamivit to pursue its legitimate business interests, conduct audits, comply with its legal obligations, resolve disputes, and enforce our contracts.
You may request a review, correction, deletion, or other modification of your personal information that you previously provided to us through Miamivit Properties. If you created an account with Miamivit, you can usually update your user settings, profile, organization settings, or activity log by logging into the relevant Site or Service with your username and password and editing your settings or profile. To update your billing information, close your account, and/or request the return or deletion of your Personal Information associated with your account, please contact your account representative or the customer service team of the relevant Service. For requests to access, correct, modify, or delete your Personal Information, please see the "Contact Us" section below. Requests to access, modify, or delete your information will be responded to within a reasonable timeframe. If you are a Miamivit customer, you can also contact your company's system administrator for assistance with correcting or updating your information.
Policy Changes
Miamivit will update this Policy from time to time. When we update, we will post a prominent notice in this section of this policy informing users when updated. In the event of significant changes (e.g., significant new practices that you did not expect from us or that we have not previously notified you of), we may decide to notify you via email. In this case, you will have the option of whether or not we use your Personal Information in this different way. We reserve the right to make changes to our practices and this Policy at any time, provided we follow the procedures above.
If Miamivit undergoes a business transition process such as a merger, acquisition by another company, or sale of all or part of its assets, your personal information collected through our website(s) may be among the transferred assets. A prominent notice will be posted on our website for 30 days following such a change in ownership or control of your personal information.
This Policy revises and replaces the previous versions dated August 21, 2024, May 3, 2016, March 16, 2016, August 1, 2014, and November 15, 2011. This Policy also replaces the Data RPM and Miamivit privacy policies.
